Rights of employees as per employees provident fund scheme

Employees’ provident scheme aims the old age income security; protect members and their dependent   from stoppage, reduction of earnings due to sickness, maternity, injury, unemployment and death. It is essential that each employee should know their right to get the maximum eligible benefit from EPFO. Hope the post will help you know your rights better.

1.  Right to be a member of Provident fund scheme, EDLI and Pension scheme if he is fulfilling the following conditions.

  • Employee must be working for a covered establishment. That is he is working for one of the 180 industries specified in EPF act , and no of workers in the establishment should be 20 and above
  • His salary (Basic + DA) Should not exceed 6500

2. Employees have the following right with respect to the claims and withdrawals.

  • Receive claim settlement within 30 days for final settlement or partial withdrawal from date of claim submission.
  • Employee can submit claim form to any EPF office and get the acknowledgment
  • Employee can avail claim form without any cost from EPF office and can obtain assistance from PRO (Public relations officer) in filling up forms.
  • Right to receive monthly pension even if the employer not paid dues.
  • Rights to receive provident fund dues from special reserve fund due to nonpayment of dues by employer, fraudulent withdrawal from account etc.
  • Employees have the right to receive advance for the purposes prescribed by the Act

3. Following are rights in respect to contribution

  • Employee can contribute to PF account up to 100% of his Basic salary instead 12% if he wishes to contribute voluntarily.

4. Right in respect of nomination

  • Employee can change the nominee whenever he decides within the framework of rules for such nomination.

5. Rights in respect of account transfer

  • Employee has the right to get the accumulations transferred to new account within 30 days on change of employer.

6. Rights in respect of account balance and statement.

  • Right to get annual statement of account of provident fund by 30th September of the following year

7. Rights in respect of grievances and redress

  • Have the right to file a grievance and to get a redressal, He can approach officer in charge of any provident fund office without prior appointment.

    Dear SIR,
    i AM A EMPLOYEE OF BSNL. DURING MY STAY AT VISAKHAPATNAM 2002-2004, THE DEDUCTION WAS 12% OF MY BASIC 6500, THAT IS RS780PM. SAME AMOUNT WAS DEPOSITED BY MY EMPLOYER.

    HOWEVER, FOR THE SAME PERIOD, KERALA CIRCLE HAS DEDUCTED 12% OF BASIC+DA-9850+DA. APPROXIMATELY RS1400PM WAS DEDUCTED AS EMPLOYEE CONTRIBUTION AND THE SAME AMOUNT DEPOSITED AS EMPLOYERS CONTRIBUTION.

    BEING AT VISAKHAPATNAM, I WAS LOOSING AROUNT 700 PER MONTH.

    CAN YOU SUGGEST ANY SOLUTION TO SUCH IRREGULARITY BY A SINGLE ORGANISATION HAVING DIFFERENT RULES AT PLACE TO PLACE.

    CAN I RESORT TO ANY LEGAL HELP.

    Hi Ranjith Sahoo,

    This cannot be said as irregularity, As per epf act employer liability of contribution is limited to a maximum amount which is 6500/-, however employer can provide more than 6500 ( like kerala circle do) if he desire to do so but we cannot compel. So there is no point in filing a suit.

    How many no.of working days to be done in the month of feburary in order to get fully salary, salary including weekly off’s, give me the figure for (Basic+DA),HRA = 4500,3000. Will it is calculated for 30days or for 28days, wereas feb has 28days a month. Employer to pay employee.

    Hi,
    My name is Afi, my employer refuse to give me any detail of my PF to claim. However, I’ve claimed against my employer in october,2010 for withdrawal. my employer said they have subitted withdrawal form to PF office and I don’t receive any neither no information till now.
    Again, I asked claimed receipt no# and PF a/c no# to check status, still they refuse to give any. So, how can I get any legal help ?
